Welcome to ViaPay. These Terms and Conditions (“Terms”) govern your access to and use of the ViaPay website, mobile applications, and related services (the “Platform”). ViaPay is operated by MONTEZI (PTY) LTD, a company registered in the Republic of South Africa.

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use of the Platform.

1. Description of the Service

ViaPay is a payment facilitation and software services platform that enables individuals and businesses (“Sellers”) to create invoices and payment links to accept payments from customers (“Buyers”).

ViaPay provides payment facilitation and software services. ViaPay is not a bank and does not provide deposit-taking services. Payments are processed according to standard settlement timelines and platform verification processes.

2. Platform Role and Limitations

ViaPay provides technical tools to facilitate payment processing. ViaPay does not:

Payments made via ViaPay are processed through secure payment links.

Payouts to Sellers are processed after transaction completion and verification, in accordance with standard settlement timelines. ViaPay does not act as an escrow or custodial service and does not make determinations regarding delivery or fulfillment of goods or services.

Payouts are not instant, and first payouts may be subject to additional verification and review to ensure account and identity validation.

6. Verification and Compliance

To comply with applicable laws and payment-provider requirements, ViaPay may require identity and business verification, including:

7. Refunds and Chargebacks

Refunds may be processed where required by law, payment-provider rules, or mutual agreement between Buyer and Seller.

Chargebacks are governed by the rules of the underlying payment networks and issuing banks. Sellers are responsible for responding to chargeback requests and providing supporting documentation.

ViaPay is not responsible for losses resulting from chargebacks or disputes between users.

8. Disputes

Buyers and Sellers are encouraged to resolve disputes directly. ViaPay may provide technical support related to payment processing but does not guarantee outcomes or assume liability for disputes between users.

All Platform content, branding, software, and intellectual property are owned by MONTEZI (PTY) LTD. Unauthorized use is prohibited.

11. Limitation of Liability

To the maximum extent permitted by law, ViaPay and MONTEZI (PTY) LTD shall not be liable for indirect, incidental, or consequential damages arising from use of the Platform.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. All disputes shall be subject to South African courts.

13. Changes to Terms

ViaPay may update these Terms from time to time. Continued use of the Platform constitutes acceptance of updated Terms.
