Terms and Conditions

Welcome to ViaPay. These Terms and Conditions (“Terms”) govern your access to and use of the ViaPay website, mobile applications, and related services (the “Platform”). ViaPay is operated by MONTEZI (PTY) LTD, a company registered in the Republic of South Africa.
By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use of the Platform.
1. Description of the Service
ViaPay is a payment facilitation and software services platform that enables individuals and businesses (“Sellers”) to create invoices and payment links to accept payments from customers (“Buyers”).
2. Platform Role and Limitations
ViaPay provides technical tools to facilitate payment processing. ViaPay does not:
- guarantee the delivery, quality, or legality of goods or services sold by Sellers;
- act as an intermediary in the fulfillment of goods or services;
- make determinations regarding delivery, performance, or satisfaction.
All transactions occur directly between Buyers and Sellers. ViaPay does not operate as an escrow or custodial service.
3. User Eligibility and Accounts
To use ViaPay, you must:
- be at least 18 years old;
- be a South African resident (Sole Trader) or a registered business entity;
- provide accurate and complete information;
- maintain the security of your account credentials.
ViaPay reserves the right to suspend or terminate accounts that violate these Terms or applicable laws.
4. Seller Obligations
Sellers agree to:
- accurately describe goods or services offered;
- comply with the Consumer Protection Act of South Africa;
- fulfill transactions in a lawful and timely manner;
- respond to customer queries professionally;
- ensure compliance with all applicable regulations relevant to their business.
5. Payments and Settlement
Payments made via ViaPay are processed through secure payment links.
Payouts to Sellers are processed after transaction completion and verification, in accordance with standard settlement timelines. ViaPay does not act as an escrow or custodial service and does not make determinations regarding delivery or fulfillment of goods or services.
6. Verification and Compliance
To comply with applicable laws and payment-provider requirements, ViaPay may require identity and business verification, including:
- government-issued identification (ID/Passport);
- proof of address;
- bank account verification.
ViaPay may suspend or restrict accounts pending verification or suspected misuse.
7. Refunds and Chargebacks
Refunds may be processed where required by law, payment-provider rules, or mutual agreement between Buyer and Seller.
Chargebacks are governed by the rules of the underlying payment networks and issuing banks. Sellers are responsible for responding to chargeback requests and providing supporting documentation.
ViaPay is not responsible for losses resulting from chargebacks or disputes between users.
8. Disputes
Buyers and Sellers are encouraged to resolve disputes directly. ViaPay may provide technical support related to payment processing but does not guarantee outcomes or assume liability for disputes between users.
9. Prohibited Activities
Users may not use ViaPay to facilitate payments for:
- illegal goods or services
- gambling, betting, or lottery services
- pyramid or Ponzi schemes
- any activity prohibited by South African law
10. Intellectual Property
All Platform content, branding, software, and intellectual property are owned by MONTEZI (PTY) LTD. Unauthorized use is prohibited.
11. Limitation of Liability
To the maximum extent permitted by law, ViaPay and MONTEZI (PTY) LTD shall not be liable for indirect, incidental, or consequential damages arising from use of the Platform.
12. Governing Law
These Terms are governed by the laws of the Republic of South Africa. All disputes shall be subject to South African courts.
13. Changes to Terms
ViaPay may update these Terms from time to time. Continued use of the Platform constitutes acceptance of updated Terms.
